While the Council is at liberty to continue with a UDRP Task Force that is
not geographically diverse, it would be somewhat analogous to convening a
committee to study the At-Large whose composition included no At-Large
Directors, no candidates for At-Large seats, nor any representatives of
At-Large organizations... the appearance of bias will necessarily be there,
and will assuredly taint your conclusions.
No one questions either the integrity, skill-sets, or the knowledge of the
currently selected participants, but it is safe to conclude that if
objections to the TF report emerge, the non-North-American world will view
any proposal tendered as no more than the continued effort to impose
US-centric values.
You can resolve this issue by adding additional members to your Task Force.
You have no rules that prohibit adding additional members, and you did vote
to change the rules recently so that the NCDNHC could include Michael
Froomkin in the TF. With any luck, this Task Force might become the
equivalent of an open Working Group. Or you can blindly charge ahead as
directed by your Council Chair fully prepared to accept all the criticism
that you know will be hurled in your direction.
You don't need to make a critical mistake at this point just to prove that
the Council is finally capable of getting some work started. A justifiable
minor delay is preferable to pending charges of undue North American bias.
