Apologies for the late submission and the stand alone e-mail format.  I
attempted to add the edits below to the report but the text disappeared
below the page frame.  

See suggested edits for section 3.1.1 (in bold) for the proposed list of
"extenuating circumstances" and 3.1.2 (in italics) for the "termination of
the registration agreement" phrase.  


3.1.1  

Suggested replacement text:

At the conclusion of the registration period, failure by or on behalf of the
Registered Name Holder to consent that the registration be renewed within
the time specified in a second notice or reminder shall, in the absence of
extenuating circumstances, result in cancellation of the registration by the
end of the auto-renew grace period (although registrars may choose to cancel
the name earlier).  As a mechanism for enforcing this requirement,
registries may elect to delete names for which an explicit renew command has
not been received prior to the expiration of the grace period.

[We discussed and agreed on the need to make the list non exclusive and the
notion that this list could serve as guideance to registrars and ICANN for
determining whether additional cirucmstances could be considered to be
"extenuating"]

-	court order
-	domain name subject to litigation 
-	failure of a registrars renewal process (which does not include
failure of a registrant to respond)
-	the domain name is used by a nameserver that provides DNS service to
third parties (additional time may be required to migrate the records
managed by the nameserver)
-	the registrant is subject to bankruptcy proceedings
-	payment dispute or discrepency where a registrant or registrar
claims that sufficient payment has or has not been made or received  [Not to
be included in text.  Perhaps 	included in Comment Box:] examples of
payment discrepencies: (i) incorrectly crediting payments received from
registrants, (ii) failing to credit any account, (iii) registrant
mailing checks to incorrect address, (iv) registrar receive paperwork in
different languages, (v) receiving unauthorized payment -- not from a US
bank or not in US dollars, e.g., 	and (vi) receiving payments which
are later denied by the financial institution for reasons such as NSF. 
-	Billing disputes 



GIVEN OUR DISCUSSION YESTERDAY, CONFIRMING THAT THE INTENT OF SECTION 3.1.2.
IS FOR SITUATIONS WHERE THE REGISTRAR OR REGISTRANT TAKE PROACTIVE MEASURES
TO TERMINATE THE REGISTRATION AGREEMENT,  I WOULD HOLD THE FOLLOWING
SUGGESTED EDIT.  

3.1.2  In the absence of extenuating circumstances, a domain name  must be
deleted within 45 days of the record expires date of the domain name
registration.
