The American Internet Registrants Association (AIRA) has filed a
court brief asking the court to rule that VeriSign, Inc. is liable for
mishandling Internet domain names. The brief, filed in the Ninth
Circuit Court of Appeals, was filed in a case brought by
Gary Kremen, an entrepreneur who is seeking damages as a
result of the hijacking of his Internet domain name 'sex.com'
by an individual named Stephen Cohen.
The lower court recently ruled that Kremen is entitled to
$65 million in damages, but that VeriSign (formerly Network
Solutions, Inc.) is not liable despite Kremen's contention that
the company was grossly negligent in permitting Cohen to
hijack the Internet domain name. The AIRA filing follows
a similar filing this month by the Electronic Frontier
Foundation (EFF), in which the San Francisco based
civil liberties group urged the Ninth Circuit Court to
hold VeriSign responsible for illegally transferring names.
Washington attorney William Bode, who filed the brief
on behalf of AIRA, said that the Association has received
countless complaints from Internet domain name registrants
who have lost their domain names because of VeriSign's negligence.
