I spoke to your colleague
Barbara Blackwell over the phone today and have been asked to contact you
instead.
I am writing to express
concern and request action over the activities of six Registrars who appeared to
submit applications ONLY for a single customer, in last week’s release of .biz
names.
I have set out, below, the
details of what appears to be a conscious action to prejudice the fair operation
of your Registry : action which exploits Registrars privilege and sets the rest
of your consumers at a clear disadvantage.
The forums are already
ringing with unhappiness about this : for example, I refer you to ICANN’s own
New TLDs forum at http://forum.icann.org/newtldevaluationprocess
Let me put this approach to
you in a friendly and honest context : I have watched your registry closely and,
having analysed a large number of your registrations, I am clear that Neulevel
acted with fairness and efficiency in the execution of last week’s “round robin”
process. There was no bias shown towards individual registrars and a just
distribution of names to all registrars (from which, however, I must exclude six
Registrars who acted against the interests of Neulevel and the Internet
community).
Having been very closely
involved in the events of the Afilias roll-out (my group was, with some good
reason, a scourge of the .info “abomination” – to use Robert Connelly’s term) I
must say that .biz has compared very favourably and for that we should all be
grateful.
Indeed, I have personal
reason to be grateful to your processes because, although I only applied through
one Registrar, I was lucky enough to obtain www.football.biz which I have great plans to
commercially develop. I therefore have a vested interest in an ongoing
collaboration with Neulevel and .biz – I do not have prejudice against your
company or an axe to grind.
Nevertheless, I believe
there is overwhelming evidence to suggest that a number of registrars made deals
to only submit .biz applications for a single person, to the exclusion of the
rest of the Internet community. This cannot be right and threatens the integrity
of your Registry.
I believe there is a strong
case for deleting all the names gained through the six Registrars who appear to
have submitted lists for ONLY ONE PERSON.
The TLD Agreement with ICANN, Appendix F (defining
the Registry-Registrar Agreement), Exhibit E, Section III:
Allows for the Registry to CANCEL registrations (i)
"to protect the integrity of the Registry".
I believe that it is reasonable to request Neulevel
to take this action, because the integrity of your registry has been
jeopardised, and specifically your undertaking that "domain names must be
allocated in an entirely impartial manner so that no party or parties may claim
special privilege in registering a domain name in the new TLD space." (Statement
to ICANN in initial sales pitch to win the Registry)
I also feel that, at the very least, Neulevel
has an obligation to explain to their consumers and the Internet community why
this was allowed to take place, and what action if any they feel appropriate to
take.
I am writing to you in all friendliness, but in the
form of an open and public letter (believing in openness and transparency) which
I am posting to a number of forums, so that people can publicly monitor the
response that Neulevel makes to this issue.
I am also sending copies to Vint Cerf and Stuart
Lynn, to contacts at The New York Times and The Washington Post, and to Fred
Upton. The case is also being posted and observed at Icannwatch.
Will Neulevel take what I would call the "Afilias"
route of silence, denial, and evasion?
Or will they prove to be consumer-friendly and engage
in dialogue?
This should be an issue which can be resolved
QUICKLY, amicably, and with due recognition of the rights of ordinary consumers
who were NOT able to participate in the .biz release with the same privilege
afforded to these six individuals.
Therefore I believe their registrations should be
canceled; and/or the Registrars involved should be called to answer; because the
INTEGRITY of the Neulevel registry requires it.
* * * * * * * * * *
Turning to the details of
our concern:
An
analysis of 503 key .biz names (posted at The Internet Challenge )
reveals interesting variations between the numbers of top-quality domains
obtained by different registrars.
OnlineNIC emerged at the top, with
twenty times more of these names than bottom-placed Network Solutions.
Nevertheless, this can be explained by the different types of customers using
the various Registrars. Overall the distribution seemed fair and
unbiased.
More
concerning, in the case of six registrar companies, was the discovery that a
single applicant obtained all their top quality names (for example Tarek Soliman
obtained all 16 of the 16 names registered through PhillipinesRegistry.com and
used in the sample). Since the analysis was carried out we have now found that
Tarek Soliman obtained 123 names through PhillipinesRegistry.com. Not a single
other registrant has been discovered for us, who obtained a .biz name last week
through this registry.
This has
led to complaints that other customers might have lost out because certain
Registrars were only supplying one individual or themselves.
It seems
inexplicable that ALL a registrar's key domain registrations should have gone to
an individual customer out of all the internet users in the world. Maybe they
can explain it.
However,
until demonstrated otherwise, there is cause to be sceptical. In the light of
Registrar abuse in the .info roll-out, and given ICANN's toleration and
continued accreditation of demonstrably fraudulent registrars, the consumer has
a right to be concerned. We are looking for a different kind of leadership from
Neulevel, and for clear and definite action.
The
SINGLE APPLICANT registrars (at least with reference to these 503 key domains
which we analysed) were:

In the
wake of the .info Sunrise scam, where ICANN failed to intervene and continued to
accredit fraudulent registrars, it appears that unscrupulous companies still
feel they have a free hand to abuse agreed systems and get away with it.
ICANN's
failure to create reliable structures, and its unwillingness to police its own
systems, has led to growing calls for a fundamental shake up of the way it is
run - with the need to place far greater emphasis on consumer protection and
consumer interests.
Questions that have been asked in
forums in the past two days include: What were the Registry/Registrar rules on
the submission of lists? WERE there any rules to protect consumers against
registrars abusing the system? Were any rules broken? Is ICANN satisfied that
registrars applying for just one customer, out of the whole world, is an
acceptable process? Is ICANN responsible, ultimately, for this process? Will
ICANN continue to accredit, endorse and advertise Registrars who are shown to
have acted against the interests of the Internet
Community?
In all friendliness, Mr Neumann,
if Neulevel has fallen victim of a loophole, its integrity and credibility (as
well as its obligations to its consumers) requires that it takes action over
this.

It is blatantly clear that some registrars have
handed over their lists predominantly to ONE customer (you could argue that they
might have "sold" their lists on, but we'll wait to see about that).
The
real issue is:
Should individuals be allowed to "buy" preferential treatment, which
prejudices the rest of the worldwide community?
Should Registrars abuse their position of privilege at the expense of
ordinary consumers?
Should the Registry and ICANN have constructed safeguards and
mechanisms to prevent this kind of abuse (eg reading the lists which were
submitted to see what is patently visible to anyone by accessing the WHOIS)?
Should ICANN continue to accredit and promote Registrars who are
shown to exploit and abuse mechanisms like these?
ICANN took no sanctions against Registrars who were demonstrably
fraudulent in the .info Sunrise. The message to Registrars was: you can get away
with anything you like.
Some of
these matters are for ICANN to address, and not Neulevel. However, it is the
integrity of the Neulevel registry that is at stake here.
If
Registrars are not available to everyone, then Neulevel are not able to fulfil
the promises made in their initial bid to ICANN to run this Registry - where
they said:
"domain names must be allocated in an entirely impartial manner so
that no party or parties may claim special privilege in registering a domain
name in the new TLD space."
What
does the PhillipinesRegistry, Neulevel, and ICANN have to say about it? In a
culture of "openness and transparency" we should reasonably expect some comment,
some explanation.
I
implore you to set new standards by entering into open dialogue over this,
instead of evading genuine concerns and issues. In this way, by adopting
openness, you will create a style and reputation for openness which will
distinguish you from the operations of other registries (such as
Afilias).

From these figures, I think it is fair to say that
the distribution shows no irrational bias towards a particular registrar. The
Registry appears to have played by the rules. Whether the rules are tight enough
to avoid abuse is another matter.

CONCLUSION:
Please could you –
- Kindly
acknowledge receipt of my e-mail (or detail a colleague to do
so).
- Investigate the cases of
these SIX Registrars and let us know, in your reply, whether they have indeed
been run largely or completely for the benefit of a SINGLE
applicant.
- Inform us
of any action you intend to take, to remedy the prejudice suffered by all your
other customers around the world.
- Guarantee
a refund of lost pre-registration fees (where applicable) to customers who
paid for the chance to win these lost names in a fair and equal
system.
- Detail
the safeguards and instructions set in place by Neulevel and ICANN, for
example through Registry/Registrar agreements to make sure this kind of
predictable abuse did not take place.
- Let us
now if you intend to take up the actions of these registrars, if it is found
that they did indeed exploit privilege and stain the integrity of your
processes : and in particular, let us know if you will call on ICANN to
investigate and review their accreditation and promotion of these
Registrars.
- Tell us
what lessons will be passed on from this “Proof of Concept” to Afilias, in
advance of their Landrush 2, so that the same mistakes are not made all over
again.
Finally,
can I take this opportunity to congratulate you on the otherwise smooth running
of last week’s operation, and wish Neulevel well in its future development and
aspirations. The Internet Public, the DoC, and public opinion are losing
patience with a culture of unaccountability and opaque dealings which have been
far too prevalent in a number of Registrars, at least one Registry, and some
parts of ICANN. There is a tide of opinion turning against this culture which
accommodates or presides over corruption. I call on Neulevel to be part of the
new, and not part of the old. I CHALLENGE you, in openness and transparency,
putting the interests of consumers first, to be part of a better
INTERNET.
