  If these berger fast food chains are selling their bergers using a similar
name ( Big Mac for instance), than McDonalds does have a legitimate
legal concern and can get any other burger fast food chain doing so
to discontinue that process and also collect some damages as well.

  But this is not really a valid comparison to the two .BIZ's...

  Yes they can.  But in doing so the one that is the "Johnny come lately"
has created confusion in the marketplace.  As such they have contributed
to the IN stability of the DNS and therefore the internet....  Not a good
thing to do...
