This could be achieved through the use of "Chartered TLD's" and a
good suggestion IMHO. However a precedent could be set doing this
where all new TLD's would be "Chartered TLD's". This however does
not address the shared and non-shared issues for new TLD or multiple
shared registries.

Nor should it be used as a tool before the fact either. Good point
here
