Yes it was.  What is interesting, though, is that at the moment, the 
UDRP is the only policy listed on that appendix.  The agreement 
makes it clear that registry operators will have little choice but to 
comply with future additions to policies and that a delegation could 
be pulled.  

Now why would a company spend hundreds of thousands, if not 
millions of dollars knowing that a few people backed by special 
intersests could pull it out from under them.  

ICANN is doing quite well with its goal of ruling the Internet to the 
detriment of all of us unless they can be stopped.
