This is not how it works. ICANN controls the root. When ns.eu.net
disappeared in the bankrupt of KPNQwest, ICANN refused to update the
NS delegations for the ccTLDs which refused to sign the ICANN/DOC
contract.
As of today, the problem has been solved for '.de' or '.fr' but it is
still lingering for '.al' or other domains which probably do not have
the same vocal power.
So, ICANN/DOC has a real power, unfortunately.
