Finally, the personal liability issue has been raised as a question on the
Nom-Com's FAQ, but the Staff answer is so vague as to be completely useless
as a means for volunteers to assess their potential risk. Again, ICANN has
demonstrated only how good it is at creating jobs for new Staff. Whereas it
would have a 5 minute job to post the actual text of the Liability Insurance
Policy Document, in particular the Declarations Page that states the actual
sums insured, instead, somebody hired from the creative writing workshop has
wasted a few lunches to replace essential insurance language with warm and
fuzzy ICANNspeak, that simply stresses "significant protection to ICANN
Volunteers". Don't bank on it.
What would actually be useful to know would be:-
1) what is the maximum payout on any one claim against an individual?
2) What is the aggregated amount of claims that can be paid in any one
policy period?
3) Who is to be the judge of whether the person has been acting in good
faith or not?
4) What are the other conditions and limitations to which you refer?
I assume an individual would actually need to have this information
available to them before they could judge whether or not to volunteer to
serve on the Board, Non-Com, ALAC, and so on, so perhaps one of you who is
already in that position of personal liability, would expand on this aspect
for the benefit of others who may be next in the firing line.

"2.13 How are ICANN Directors, GNSO Council members, and ALAC members
protected from liabilities arising from their service on these groups? Are
they indemnified by ICANN? Is there liability insurance?"

"Although there are various conditions and limits on each type of
protection, in the aggregate these protections provide significant
protection to ICANN volunteers acting in good faith and in the scope of
their responsibilities to ICANN."
