Milton - I think these comments are a bit disingenuous. Neither the
NC nor the Board is about to sanction a sponsored registry agreement
for dot-org that contains either of these provisions, so the alleged
danger is a red herring.
As you and others have complained about, the level of detail in the
sponsored agreements that have just been completed is intended to
ensure that the promises made by the applicants are enforceable in
their subsequent agreements with ICANN. The promises in turn are
derived from the criteria and policy rules contained in the Board's
decision on the manner in which the registry is to be [in this case]
redelegated. So the object here is to identify, find consensus for,
and recommend the right set of dot-org policy principles to the
Board, and let the application, selection and agreement process
appropriately memorialize them.
