Just a quick followup...
It has been pointed out to me that there is a relevant question on the survey
asking whether the decisions "should" be public domain, but I've never heard
of a provider making a claim that they weren't.
The question is, I suppose, relevant to the non-WIPO DRP's, since WIPO
provides the following terms of use for all information at its website:
http://www.wipo.int/about-wipo/en/disclaim.htm
1. Anyone may use or reproduce any information presented on this website,
subject to any specific terms of use that might appear with such information,
provided that the use of such information is accompanied by an
acknowledgement that WIPO is the source.
No specific terms of use appear with WIPO's UDRP decisions, so those
decisions are covered by their general disclaimer of exclusive reproduction
rights.
eResolution has three pending cases - one dating back to June of last year -
and it is unclear whether they will maintain a perpetual home for their
decisions now that they are no longer a DRP. It would be helpful to know
whether their decisions may be archived elsewhere when they finally pull the
plug on life support.
