Clearly, the review of the bylaws with respect to NC elections is most
time-sensitive and should proceed quickly.
That being said, however, a more comprehensive review of the bylaws has been
under consideration since at least last Spring. This is due, as I recall,
to the interest in strengthening the constituency and to the opportunities
to do so now that we have a strong exec. team in place and a number of new
constituency members. The next several months presents a good opportunity
for us to make progress on several issues that can strengthen the
constituency, and I don't see any reason not to begin that process
(particularly when we have a drafting volunteer in Liz).

My $0.02... a review of the by-laws for the purpose of facilitating the
election, a review of the by-laws to facilitate our standing in a new ICANN
structure and a review of the by-laws to facilitate our long-term goals are
very specific and unique propositions. Let's not distract ourselves from our
immediate goals with an attempt to solve all of the problems at once. Each
are, in principle, worthy objectives, but they do require distinct analysis
& deliberation...
My preference would be to undertake a consultation with the constituency to
gain a more thorough understanding of the goals and objectives that each
member has and allow that to frame a further discussion of what we want our
by-laws to do and where improvements can be made.
My only real concern about the proposal that you make Liz, is that a
pre-Ghana deadline will not allow for a complete consultation, review and
analysis to occur. A consideration of this import must not be rushed because
of externalities.

One further thing from my list of outcomes/notes from the RC meeting that I
forwarded to the ExCom yesterday is that we talked about reviewing the
bylaws with respect to Names Council elections.
I think there's merit in a more comprehensive review of our bylaws as we put
the RC on stronger footing, operate with an efficient ExCom and try to track
and implement decisions we make. We also need to be consonant with what the
ccTLD and gTLD are doing if we expect to "partner" with them in the proposed
"providers" category for the Board restructuring.
I don't want to add further to the ExCom's load and am willing to work with
whomever to do a comprehensive review of the bylaws prior to the pre-Ghana
meeting.
I'd expect that we should frame any discussions around "what do we want
by-laws to do?; are the existing by-laws enabling us to do that?; where can
improvements be made".
If Tim can forward me his review of other constituencies by-laws, I'll work
something up for consideration by the group. I'll ask for volunteers from
the broader constituency if everyone's happy for that to proceed.
