[registrars] Two queries: re-purposing, and log data (law enforcement)

There's a story in the Boston Globe which mentions, but does not name, some
eleven domain names that the US DOJ is seeking court order(s) to host on a
DEA web server.

#1. What is the registrar story on jurisdictional re-purposing, or is this a
registry-only local jurisdictional play?

There's a story in Haaretz that quotes Joe Sullivan (eBay/Paypal Director
of Law Enforcement and Compliance) from last week's Cyber Crime 2003, to
the effect that eBay discloses sophisticated web data w/o court order.

#2. What is the registrar story on jurisdictional redistribution, or is this
a registrant-only local jurisdictional play? If registrar also hosts? If the
scope of "data" is expanded from static (whois) registrant data, to dynamic
(business logic) registrant data?

All in all, neither development seems particularly auspicious for the use
model being "no surprises".
