in the case of alleged cybersquatting, mere possession of the domain name, 
without a corresponding believable claim to rights in the name, has been 
reason to take administrative action (under both the old NSI resolution 
policy and the new proposed ADRP).

It would be "interesting" to see this policy declared to have no basis at 
all in applicable law :-)
