RE: [wg-b] Just a thought
Michael, this is the October '99 ballot.
Question one asks constituency, question two asks region of citizenship.
QUESTION #3
[Please select ONE of the options listed below]
[x] Option A - Some type of mechanism, yet to be determined, is necessary
in
connection with famous trademarks and the operation of the Domain Name
System.
[] Option B - ICANN should not implement any mechanism for the protection
of
famous marks, because other mechanisms are adequate
[] Option C - ICANN should not implement any mechanism for the protection
of
famous marks, because it exceeds the scope of ICANN's authority
[] Option D - Both Option B & C
[] Option E - I choose to abstain from the voting process at this time
I see no option here that extends the discussion or protection, beyond
famous marks.

Judith,
In October this group reached consensus that additional mechanisms were
necessary in addition to the UDRP. Therefore, I do not believe that I am
wasting people's time. Speaking only for myself, my time is too valuable to
waste.

Michael,
Sometimes the best idea, is the one already done.
If the "focal point" of this group has become how to ensure trademark
protection in the domain name system*, then that goal is already met, more
than adequately, by the UDRP and legislative remedies already in place.
If however, the goal of this group has become "to placate the Trademark
Lobby ... (you all know the rest)" at any cost, then we have a different
"focal point", and should stop talking apples and oranges.
And you Michael, as WG-B chair, should say so, so that we're all on the same
page and stop wasting everyone's time.

*Last October you wrote me, "Our focal point must remain what protection if
any do famous trademarks have." When did this change?

The purpose of a Working Group is to stimulate IDEAS. One of the rules that
I was taught about brainstorming is that there are never any wrong ideas,
only some that are better than others. Unfortunately there have only been a
small handful of people that have offered solutions to the problems facing
this Working Group, although there never remains a shortage of people
willing to criticize the work of the handful of people putting ideas
forward. My latest idea will not be incorporated into the Working Group B
Final Report. In fact, I believe most will find it very minimalistic.
Mike
P.S. I would like to thank Harold for his idea. If anyone else has any other
ideas that have not been discussed please send them my way.
