But the reality of the fact is that the current pricing models do not
support this conclusion - the value of the domain name is equal to the gray
market price, or the number of years that the domain is used - not a finite
value that one would usually attach to property - sounds like pure rental
to me.

Not at all. Microsoft only has use over their SLD as long as their payments
are current. The fact that use of this SLD is restricted solely to MS is
only guaranteed by trademark law and entirely secondary to this arguement.

To regroup: SLDs are currently rented to the consuming public. There are is
no question about this. In fact, the incumbent also reserves the right to
revoke the use of these names at any given time through a variety of
clauses in its contract.
