There was also no consensus on the matter in the NTIA
public proceedings, and indeed, there was the highly
unusual action of the US Federal Trade Commission
expert staff filing in the proceeding arguing that
there was no basis for preferring non-profits.

Under the agreements recently reached under NTIA
aegis, restricting the service market to only
economic and institutional model would not only
lie outside of ICANN's jurisdiction, but also
constitute arbitrary and discriminatory conduct.
