Brian, you've written a fantastic manifesto against the current
UDRP insanity. Thank you for it.
Kent, I'm sure that it feels good that you got songbird.com
before somebody else did. It's a nice name. You've had it since
early 1995. It feels good to get there first and stake your
claim. I acquired a few names early too, ones that I am using.
I got them first and don't want them taken.
You won't feel good when some SongBird PLC multinational,
incorporated Feb. 2001, (for example), that you never heard of,
takes it.

Firstly, apologize for the long response.
At least in the US, trademark law offers effective protection to
trademark holders. The applications and limitations of the
trademark laws are clear, the so-called cybersquatting laws and
UDRP process and procedures are not.
The analogy of the tree and the houses is off the mark. And the
assumptions regarding costs and suffering are askew too.
