One difference is that there is no easy way to opt out, opt-in is
prohibited by ICANN, and - most crucicially in the consumer context- the
choices are not presented at sign-in.
Plus, here in Florida we have strong laws prohibiting telemarketing (you
sign up for a list, and then they may not bug you). There's no real hope
of a functional comparable way to stop spam without causing side-effects
worse than the quite virulent disease.
The procedure available for having a nominee listed as your contact person
is expensive, since not routinized, and has nasty potential legal
consequences (they can steal your domain name) unless you draft a contract
(which is expensive), and even then gives them the power to do it (which
would take an expensive lawsuit to win back). Saying, 'use a lawyer' as
your nominee ignores the happy reality that most people don't have a
lawyer on retainer, and the unhappy reality that most people couldn't
afford what most lawyers might charge.
