It would seem obvious that an association that
voluntarily coordinates claims to TLDs without
operating or controlling the operation of a
single, monopoly root server system cannot be
characterized as a "cartel."
Even if one agrees that they are defining the
content of a root zone file, they are in no
position to order anyone to accept it.
Here's my proposed contents of the global root
zone file:

That is, it provides what it purports to be the root zone file, and
provides the mechanism to decide what goes in that file. Whether it
physically operates a root server is beside the point -- ICANN doesn't
physically operate a root server, either.
