There are no legal claims, Gene.
The issue is not "legal claims" but one of simple market forces. If
there is a "large" well established TLD in the alt.root community that
is getting active use and is visible by a truly significant percentage
of the internet population, then the simple market forces will most
likely cause other roots, including ICANN, to not create a TLD of that
name in their competitive root.
