The fallacy here is assuming that ICANN falls under those regulations. As a
USG contractor, it doesn't. NSI has similarly proven this in court. As a USG
contractor, ICANN can be viewed as a USG agent and under the protection of
the USG wrt anti-trust and other normal business regulatory issues. The USG
carries a very lerge umbrella wrt its contractors/agents.
Please note, however, that this does not mean that ICANN is a regulatory
body of the USG. It is only an agent.
