First off, a lawsuit is frivilous if the plaintiff has no case.
A defense is frivolous, if it is asserted with no basis in fact.
Karl's lawsuit is in no way frivilous however ICANN has no defense based in
fact.
Would anyone here work for a company as a director without having access,
full and complete without restriction, to finances? Especially when they
are not filing timely.
If ICANN has major tax or liability problems Karl is at least somewhat
responsible - Therefor he had to file the lawsuit, no choice, not moral,
not legal and certainly not financially.
