[registrars] Potentially Misapprorpiated Whois Data?

Could you please look into the following registrant/customer of TUCOWS
(Nikomarketing.com - http://nikomarketing.com./ourdatabases.htm) which is
apparently offering new and updated Registrant Whois information (over 20
million records) for only $199.

Under Paragraph 2 of TUCOWS' domain name registrant agreement it states that
your registrant (NikoMarketing) "to the best of the [their] knowledge and
belief, neither this registration of a domain name NOR THE MANNER IN WHICH
IT IS DIRECTLY OR INDIRECTLY USED infringes upon the legal rights of a third
party" (emphasis added).

Perhaps you could investigate this matter, as I question how this
registrant/customer of TUCOWS could have legally acquired these 20 million
Whois records without violating either the Bulk Access License of some
registrar, Zone file Access agreement of the registry, or the Whois terms
incorporated into each registrars system (both web based and Port 43).

If this registrant is found to be in violation of its registrant agreement I
hope that TUCOWS would do the right thing and terminate this domain name
service agreement.
