Tim, I was thinking more like ICANN would limit it to a handful, like 7 or
less.
It would not be difficult to determine if FTC, FBI, Interpol, etc are
legitimate.
Once these few law enforcement agencies have the data, other
law enforcement agencies can request the data from them.
We would know if they (and which ones) were irresponsible with it because we
can put data 
(such as email addresses for registrar held names) that only appears 
in the bulk whois (so it would be slightly different than the port-43
output).
If ICANN limited it to one, in effect delegating the decision (on which
other agencies are legitimate) to that one agency, I'd be OK with that too.

There is no easy answer to verifying legitimate access. But I'm not
convinced ICANN is the one to do that. Since I might be able to
adequately verify law enforcement agencies in my own country, I would
prefer to see outside agencies working through them.

here is a question for you Paul, what would you do if a Thai 
law enforcement organisation would approach you to get Enom's
bulk whois. Would you grant them access to it?
