Given Mr Winer's reputation and experience in these areas, would it be possible to persuade him to posit accessory  tracking, identification and authentication procedures that might require inclusion in the charter of new TLDs to avoid the problems listed below?

This would enable registrars and registrants to operate with a fully articulated legal stance from the outset, both in terms of principles and of practice.
