Mr. Sondow,
I have seen this provision used by unacredited "Registries", who do not contribute to ICANN in order to
avoid liability in selling rights to a domain name to several different registrants.  ICANN expressed
complete lack of authority to deal with the problem, which of course is true.  It is my understanding
that a 501 c 3 corp cannot invoke the powers of the courts to impliment it's stated goals.  Obviously
there are exceptions but ICANN'S policies are impotent in effect.
