Again I must express my appreciation for the education provided by Mr.
Crispin.
My group registers trademarks and hold trademarks. But we do not fit
into any category. This Group is not representative of the people who
own intellectual property. This group should be renamed Great Big
Business Constituency. Note they have complete discretion, as opposed to
criteria, on who can get in.
B. The purposes of the IPC are to:
i. Represent the views and interests of users of intellectual
property world-wide with particular emphasis on trademark, copyright,
and related
intellectual property rights and their effect and interaction
with the Domain Name System (DNS), and to ensure that the views,
including minority
views, are reflected in the recommendations made by the Names
Council to the Board of ICANN; and
Notice the outright declaration that their views be reflected by the
Names Council. The words should have been "considered by the Names
Council when making recommendations to the BoD.
By their very charter the control the Names Council.
III. Membership
A. In General
The IPC shall consist of organizations committed to the advocacy
and development of intellectual property (including trademarks,
copyrights, and
patents) as fundamental components of meaningful commercial
activity in the national, regional, and global realms, and, more
particularly shall:
i. be primarily and substantially involved in the field of
intellectual property; and
ii. make a substantial contribution through its members or
otherwise to the field of intellectual property.
B. Categories of Membership
The categories of membership shall be:
i. Category 3: Category 3 shall consist of all international
IP organizations which meet the criteria of Article III.A. above.
ii. Category 2: Category 2 shall consist of all local, state or
purely national IP organizations which do not fulfil the requirements
for Category 3
membership.
iii. Category 1: Category 1 shall consist of any individual, or
organization which does not fulfil the requirement of Article III.A. and
B. i. and ii.
above.
C. Additional Factors
In determining eligibility for membership in the above-referenced
categories of membership, the following additional factors shall be
considered as
applicable:
i. the number of members in the organization;
ii. the international / geographic diversity of membership;
iii. the extent to which the organization is representative of a
particular industry or industry segment;
iv. the organization's standing before international bodies,
including, but not limited to WIPO; and
v. the nature and structure of the organization.
D. Participation by Non-Members
In addition, the IPCC may invite participation by non-members to
conduct its business, including individuals, organizations, other
Supporting
Organizations, and other DNSO constituencies.
E. IPCC Discretion
The IPCC has the discretion to admit, refuse, or expel any member
where on reasonable grounds, it feels it is in the best interest of the
constituency
to do so.
